Terms of Sale
By purchasing products or services from Memorment Photography, you agree to the following Terms of Sale.
1. Orders and Payment
All prices are listed in Australian Dollars (AUD) unless otherwise stated.
Full payment is required at the time of purchase unless an alternative payment arrangement has been agreed to in writing.
Orders will not be processed until payment has been received and cleared.
2. Digital Products
Digital images are delivered electronically and are subject to the Digital Image Licence Agreement.
Due to the nature of digital products, all digital image sales are final and non-refundable once files have been delivered or made available for download.
3. Print Products
All prints, wall art, albums, and other physical products are custom-made to order.
Please carefully review your selections before completing your purchase, as changes may not be possible once production has commenced.
Colours may vary slightly between screens, devices, and printed products due to differences in display and printing processes.
4. Delivery
Digital products will be delivered electronically via online gallery, download link, or other agreed method.
Physical products will be delivered to the address provided at checkout. Delivery times are estimates only and may vary due to supplier, production, or shipping delays.
Memorment Photography is not responsible for delays caused by third-party couriers or postal services.
5. Refunds and Returns
As photography products are custom created and personalised, refunds, exchanges, or returns are generally not available for change of mind purchases.
If a product arrives damaged or contains a manufacturing defect, you must notify Memorment Photography within 7 days of receiving the product. Where appropriate, a replacement, repair, or refund will be provided in accordance with Australian Consumer Law.
Nothing in these Terms excludes your rights under the Australian Consumer Law.
6. Photography Services
Session fees, retainers, and booking deposits are non refundable unless otherwise stated in your Photography Agreement.
Rescheduling requests may be accommodated at the discretion of Memorment Photography and subject to availability.
Failure to attend a scheduled session without notice may result in forfeiture of any payments made.
7. Image Selection and Editing
Final image selection and artistic editing decisions remain at the discretion of the photographer.
Raw (unedited) files are not included unless specifically agreed to in writing.
8. Copyright
All images remain the intellectual property and copyright of Memorment Photography.
Purchasing images, prints, or products does not transfer copyright ownership.
Use of digital images is governed by the applicable Digital Image Licence Agreement.
9. Limitation of Liability
To the maximum extent permitted by law, Memorment Photography's liability is limited to the amount paid for the purchased product or service.
Memorment Photography is not liable for indirect, consequential, or incidental losses arising from the use of its products or services.
10. Australian Consumer Law
Nothing in these Terms of Sale excludes, restricts, or modifies any consumer guarantees, rights, or remedies available under the Australian Consumer Law.
11. Changes to Terms
Memorment Photography reserves the right to update or modify these Terms of Sale at any time. The version in effect at the time of purchase will apply to that transaction.

Every image and product is created specifically for you. We encourage clients to carefully review their selections before purchase, as custom photography products cannot generally be resold or repurposed.
